Terms of Service

1. Introduction
These Terms of Service govern the use of the SnapMenu software-as-a-service platform that provides hosted digital menus and related services for restaurants, cafés, bars, and small hotels.
SnapMenu is operated by an individual based in Cyprus who is currently below the Cyprus VAT registration threshold and operates as a sole operator with no separate legal entity. No VAT is charged unless and until required under applicable law.
By creating an account, onboarding a venue, or paying for a subscription, you agree to these Terms on behalf of yourself or the business you represent.
2. Definitions
"SnapMenu" means the hosted menu platform and related services provided by the individual operator described above.
"Venue" means any restaurant, café, bar, hotel, or similar establishment that uses SnapMenu to host its digital menu.
"Account" means a user account created to administer one or more Venues on SnapMenu.
"Subscription" means a paid plan that provides access to SnapMenu features for a Venue during a defined subscription term.
"Menu Data" means categories, items, prices, descriptions, translations, images, dietary flags, groups, and other configuration data used to render a Venue's menu.
"Customer" means an end user who scans a QR code or visits a URL to view a Venue's menu.
3. Scope of Service
SnapMenu provides hosted menu pages that can be accessed through a subdomain or custom domain, together with configuration tools and optional analytics and SEO features. The service may include multiple establishments per account, multi-language menus, menu groups, dietary filters, layout options, and theme configuration.
SnapMenu does not provide payment processing for a Venue's Customers, does not operate the Venue, and does not act as an agent or reseller for the Venue's products or services.
4. Accounts and Venue Onboarding
To use SnapMenu, you must create an Account using a valid email address and any other information requested during onboarding. You must keep your login credentials confidential and are responsible for all activities under your Account.
During onboarding, you may provide Menu Data, branding assets, and basic Venue information. SnapMenu may configure your Venue on your behalf, provide you with a link or QR code, and give you access to an administration interface where self-service editing is enabled.
You represent and warrant that you have the authority to bind the Venue or business you represent to these Terms.
5. Subscriptions, Fees, and Payments
SnapMenu sells annual prepaid subscription plans per Venue. Plan names, current prices, and included services are displayed at the time of purchase or communicated in writing.
Each Subscription covers one physical Venue (one location). If you operate multiple locations or branches, you must purchase and maintain a separate Subscription for each location where SnapMenu is used. A Subscription bought for one Venue may not be shared across other locations, and QR codes or links issued for a specific Venue may only be used at that Venue.
Unless otherwise stated, subscriptions are billed in advance for a 12-month term. Payment is handled through third party payment processors such as Stripe, which collect and process your payment details on their own systems.
You authorize SnapMenu's payment processor to charge the applicable fees for the initial term and, if auto-renewal is enabled, for each renewal term. If payment cannot be collected, SnapMenu may suspend or terminate access to the service.
Any local taxes that become applicable in the future may be added to the subscription price as required by law.
6. Renewals and Cancellations
Unless stated otherwise, subscriptions renew annually by default using the payment method on file. You may disable auto-renewal or cancel your subscription through your Account or by contacting snapmenucy@gmail.combefore the renewal date.
If you cancel a subscription before the end of the current term, the service will continue to be available until the end of the paid term, unless you request immediate deactivation.
7. 30-Day Money-Back Guarantee
For any new annual subscription, SnapMenu offers a 30-day money-back guarantee. If you are not satisfied, you may request cancellation and a full refund within 30 calendar days from the initial subscription start date by emailing snapmenucy@gmail.com.
The guarantee applies only to the first term of a new subscription for a given Venue. It does not apply to renewals, upgrades, or subsequent purchases for the same Venue.
After the first 30 days, refunds are handled according to the separate Refund Policy, which forms part of these Terms.
8. Acceptable Use and Prohibited Activities
You must use SnapMenu only for lawful purposes and in accordance with these Terms. You agree not to:
Use the service to host content that is illegal, defamatory, abusive, discriminatory, or otherwise unlawful under Cyprus or EU law.
Infringe or violate the intellectual property or other rights of any third party.
Interfere with or disrupt the operation of SnapMenu, its infrastructure, or other users, including by attempting unauthorized access or security testing without permission.
Use the service for high-risk activities where service failure could lead to personal injury, property damage, or other serious harm.
Attempt to circumvent technical limits or usage restrictions associated with your plan.
SnapMenu may suspend or terminate access if it reasonably believes that your use violates these Terms or applicable law.
9. Venue Content and Responsibilities
You are solely responsible for all Menu Data and other content supplied for your Venue, including:
Menu items, descriptions, ingredients, prices, and availability.
Allergen and dietary information, including use of dietary flags and related filters.
Translations in different languages.
Images, logos, and other branding assets.
Establishment information such as contact details, opening hours, addresses, and social links shown in the menu interface.
You must ensure that all information shown to Customers is accurate, complete, and compliant with applicable consumer protection, food safety, and labeling laws, including allergen disclosure rules. SnapMenu does not verify Venue content and is not responsible for any errors or omissions.
If a Customer raises a query or complaint about Menu Data, that issue is between the Customer and the Venue. SnapMenu may forward any such communication to the Venue but has no obligation to mediate or resolve disputes.
10. Plan Features and Technical Limits
Plan features, configuration options, and technical limits may include multiple establishments per account, groups of categories, layout modes, theme and branding configuration, SEO options, and analytics event tracking such as page views, QR code scans, menu interactions, contact clicks, and language changes.
The current description of available features, configuration options, and analytics behavior is set out in SnapMenu's internal "Features and Configuration Guide" and "Analytics and Tracking Documentation" (together, the "Service Specifications"). These documents may be updated from time to time to reflect technical changes or improvements and are incorporated into these Terms to the extent they describe the functioning of the service and plan limits.
If there is a direct conflict between a marketing description and the Service Specifications, the Service Specifications will prevail for interpreting the technical behavior of the service.
11. Data Protection and GDPR
For the purposes of the EU General Data Protection Regulation (GDPR), SnapMenu acts as:
An independent data controller for personal data collected through SnapMenu's own website, account management, billing, and usage and analytics data that SnapMenu configures for its own service improvement and reporting.
A data processor for personal data contained in Venue-supplied content and configuration where SnapMenu stores, hosts, or displays that data on behalf of the Venue.
As a processor, SnapMenu will:
Process Venue personal data only on documented instructions from the Venue, including these Terms and any written configuration provided.
Implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or disclosure.
Ensure that persons authorized to process personal data are bound by confidentiality obligations.
Use sub-processors such as hosting providers, analytics services, and payment processors, and ensure they are subject to data protection obligations consistent with GDPR.
Assist the Venue, where reasonably possible, with fulfilling data subject access requests and other GDPR obligations, taking into account the nature of the processing and the information available to SnapMenu.
Delete or return personal data stored on behalf of the Venue at the end of the provision of services for that Venue, subject to legal retention obligations and any data that SnapMenu must retain as an independent controller.
When SnapMenu configures analytics such as Google Analytics 4 or Google Tag Manager, it may track events including page views, QR code scans, menu interactions, contact clicks, language changes, and error events, together with context like establishment identifiers, locale, UTM parameters, and technical metadata. These events are used to provide aggregated usage insights and to improve the service. Analytics may be disabled in non-production environments or in specific deployments.

12. Service Availability and Modifications
SnapMenu aims to provide a reliable service but does not guarantee uninterrupted availability. The service may be unavailable due to planned maintenance, urgent security updates, technical issues, or events outside SnapMenu's reasonable control.
SnapMenu may change or discontinue features, introduce new features, or modify technical implementation at any time. Where changes materially affect your use of the service, SnapMenu will use reasonable efforts to notify you in advance through email or the administration interface.
13. Disclaimers and Limitation of Liability
SnapMenu provides the service on an "as is" and "as available" basis. To the maximum extent permitted by law, SnapMenu disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
SnapMenu is not responsible for:
The accuracy, completeness, or legality of Venue content.
Any decisions made by Customers based on a Venue's menu, including dietary or allergen choices.
Third party services, infrastructure, or networks that SnapMenu does not control, including internet connectivity, hosting providers, analytics providers, and payment processors.
To the extent permitted by law, SnapMenu's total aggregate liability arising out of or in connection with the service for any claim in any 12-month period is limited to the total subscription fees paid by you to SnapMenu for the affected Venue during that period.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud or for death or personal injury caused by negligence.
14. Indemnity
You agree to indemnify and hold harmless SnapMenu from and against any claims, losses, damages, liabilities, costs, and expenses arising out of or in connection with:
Your Venue content, including Menu Data, images, and establishment information.
Your breach of these Terms or applicable law.
Any dispute between you and a Customer or third party relating to your Venue or offerings.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict of law rules.
Any dispute arising out of or in connection with these Terms or the service that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Cyprus.
16. Changes to These Terms
SnapMenu may update these Terms from time to time. When changes are made, the "Last Updated" date may be revised and reasonable efforts will be made to notify active subscribers. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
